MO Workers Denied Work Comp Benefits May Sue Employer in a Negligence Action
In an unusual ruling, the Missouri Supreme Court finds that an employee excluded from collecting worker's comp benefits may sue an employer for negligence in Circuit Court. The exclusive remedy doctrine of workers comp is not applicable.

Kansas Supreme Court Ruling on Work Disability Lessens Claimant's Burden of Proof
K.S.A. 44-510e(a) contains no requirement that an injured worker make a good-faith effort to seek postinjury employment to mitigate the employer's liability. Foulk, Copeland, and all subsequent cases that have imposed a good-faith effort requirement on injured workers are hereby disapproved.

The Kansas Division of Worker's Compensation released the benefit levels effective for all injuries occuring on or after July 1, 2009.
